Emancipation following the American Civil War meant that freed slaves gained the right to reunite with their biological families or to construct new ones outside the influence of the households to which they had been bound as slaves. In some households, however, emancipation had little effect on family structure; former slaves continued to live with the white families they had served. To identify why some family structures persisted unchanged for many years after emancipation, this dissertation focuses on two mixed-race Missouri households, the Keen family of St. Charles County and the Hickam family of Cooper County. Nothing changed in either household until after the deaths of the family patriarchs, at which time both families became embroiled in intra-family legal disputes over the inheritance rights of black members. The Hickam and Keen cases were argued before multiple county and state courts that ruled not only on inheritance rights but also on the very definition of family. By examining the Keen and Hickam cases in the context of local and national trends, this study shows that changes in the way race and gender have been constructed over time can explain the persistence of some racially mixed households in the post-bellum years, as well as challenges to their legitimacy. Lawsuits whose outcomes helped to reinforce a state-defined notion of family as uni-racial illustrate the shift in patriarchal power dynamics after the Civil War. The New South refused to tolerate the conflation of mixed race families that the Old South had permitted.
